The Solid and Hazardous Waste Division (SHWD) Consists of Five Separate Programs:

The Solid Waste Permitting and Corrective Action program  is responsible for permitting the location, design, construction, operation, monitoring, closure and post-closure care and remediation of solid waste management facilities.

Recent legislation provides partial monitoring cost reimbursement to local government entities required to install monitoring systems at municipal landfills.  In addition, the legislation requires that all local government entities operating municipal landfills prepare Integrated Solid Waste Management (ISWM) plans by July 1, 2009.  Funding assistance has been provided for this purpose as well. Hazardous Waste Permitting and Corrective Action

The Hazardous Waste Permitting and Corrective Action Program issues permits for the operation and post-closure care of regulated hazardous waste treatment, storage and disposal facilities. The program also imposes corrective action requirements necessary to clean up past releases of hazardous chemicals from these facilities, either as a component of the facility permit, or as a corrective action order. There are currently nine regulated hazardous waste treatment, storage or disposal facilities in the state. Two of these facilities are operating hazardous waste management units, and the remainder are treatment, storage or disposal facilities at closed industrial sites. Listings of the regulated facilities are available.

The Hazardous Waste Permitting and Corrective Action Program also oversees corrective action activities at a number of other facilities where there have been releases of hazardous chemicals to the environment. At these other facilities, corrective action activities are typically governed by orders issued to the responsible party. Following passage by the Wyoming Legislature of the state’s new Voluntary Remediation of Contaminated Sites law in the 2000 session, contaminated site owners now have a choice to have their cleanup activities reviewed by DEQ pursuant to a corrective action order, or under the voluntary remediation procedures of the new law.  (back to top of page)

Voluntary Remediation

The Voluntary Remediation Program is responsible for three functions: assisting volunteers through the process of characterizing contaminated sites and developing remedy agreements to establish cleanup requirements for the sites; developing incentives to encourage site owners and potential site developers to enter the voluntary remediation program and voluntarily clean up contaminated sites so they are returned to productive uses; and to assess and clean up orphan contaminated sites where there are no viable responsible parties. Inspection and Compliance

The Inspection & Compliance group (Contacts) is responsible for assuring Wyoming governmental, business and industrial entities are in compliance with the Wyoming Solid and Hazardous Waste Rules & Regulations. The following types of inspections are performed by the group to assure compliance: open and closed municipal landfills; industrial landfills; construction/demolition landfills; solid waste transfer, treatment and storage facilities; hazardous waste generators; used oil generators; hazardous waste treatment, storage and disposal facilities (TSDs); asbestos management facilities; and petroleum-contaminated soils facilities.  The group uses various regulatory inspection checklists to assure compliance with the rules and regulations. (Compliance) The group also responds to various types of solid and hazardous waste complaints and conducts followup inspections to ensure compliance.

To ensure compliance, the group will issue either formal or informal enforcement actions.  Informal enforcement action consists of informal letters, warning letters and letters of violation (LOV).  Formal actions include issuance of Notices of Violation (NOV), Cease & Desist Order, and Referral for Penalty to the Wyoming Attorney General Office. Formal enforcement actions are used to deter problem violators and is used only after all efforts have been made through conference and conciliation, to return the violations to compliance.

The purpose of this web site is to provide regulatory assistance and guidance to state regulated entities with the Wyoming Solid & Hazardous Waste Rules & Regulations. Training videos are also available on this web page to assist with the proper understanding of the rules and regulations. 

Storage Tank Program

The Storage Tank Program (STP) administers Article 14 of the Wyoming Environmental Quality Act (the Act) and Chapters 17 and 19 of the Wyoming Water Quality Rules and Regulations.  Two primary functions of the STP are to: 1) ensure tank system owner/operator compliance with the Act and rules/regulations, and 2) oversee corrective actions at eligible sites contaminated by leaking aboveground and underground storage tanks.

STP compliance personnel conduct tank owner/operator training and outreach programs to assist the regulated community in understanding requirements.  On-site inspections of tank systems regulated by the program to ensure compliance are also completed.   When a violation exists, the program carries out compliance-related activities, such as discussions with the owner/operator, proceeding with enforcement actions, and referring violations to the Attorney General’s Office for judicial action.

STP remediation personnel coordinate cleanups at eligible sites contaminated by leaking aboveground and underground storage tanks.  Remedial activities are accomplished using consultants and contractors with STP staff overseeing the work.  Remediation work is completed at both source sites and affected third party sites (impacted due to location near a source site).  Projects typically involve five phases:  subsurface investigation to determine the magnitude and extent of contamination, engineering design of remedial alternatives, construction and equipment supply for the designed systems, operation and maintenance of the systems, and project closure when state soil and groundwater standards have been met.
